Child Protection Policy

CENTRE NAME

BIRTHMARK LEARNING CENTRE

Children’s rights are protected in the South African Constitution and The Children’s Act 28 2005 gives effect to those rights. Everyone working with children must respect, protect, promote and fulfil the rights of children set out in the Children’s Act.

Our Centre aims to uphold and entrench these rights in all our interactions with children.

We therefore:

Respect children’s rights. We will not interfere with children’s enjoyment of their rights.

Protect children’s rights. We will take the necessary action to prevent other people from interfering with (or violating) children’s rights.

Promote and fulfil children’s rights. We will take action and put programmes in place to make these rights a reality.

Children’s rights

We acknowledge that children have the following rights and will do everything in our power to ensure that the best interests of the child should be put first in every matter affecting the child (or a group of children)

The following children’s rights are respected in our centre:

to be heard

to freedom of expression

to information

respect the child’s dignity and treat children fairly and equitably;

protect the child from unfair discrimination – including discrimination based on the health status or disability of the child or his or her family;

recognize the child’s need for development – including the need for play and recreational activities that suit the child’s age; and

recognise a child with a disability and respond to his or her special needs.

In any matter concerning the child we will ensure that:

the child’s family should be given an opportunity to express their views (if that would be in the child’s best interests);

conflict should be avoided and people should work together to resolve their differences;

delays are avoided in taking actions or making decisions; and

the child (depending on his or her age, maturity and stage of development) and the person who has rights and responsibilities in respect of the child must be informed of any actions or decisions that will significantly affect the child, and be made part of the decision-making process.

STAFFING

We recognize that it is the responsibility of all staff to create a safe and nurturing learning environment and that each individual child is valued, respected and included.

All staff (including volunteers) working at our centre will:

Be trained on the child protection policy

Be trained on all safety and emergency procedures

Will be screened prior to employment to establish whether their name is in the National Child Protection Register (Form 29)

Never use physical punishment

Take all reports of abuse of a child seriously and report this to management immediately

Access to the premises will be strictly monitored and all visitors will be required to sign the visitors register.

The following behavior is never acceptable and staff found to be engaging in such behavior will be sanctioned:

Hitting or otherwise physically assaulting or physically abusing children.

Developing a sexual relationship with a child.

Developing a relationship with children which could in any way be deemed exploitation or abusive.

Acting in ways that may be abusive or may place a child at risk of abuse.

Using language, make suggestions or offer advice that is inappropriate, offensive or abusive.

Behaving physically in a manner that is inappropriate or sexually provocative.

Having (a) child/children with whom they are working stay overnight at their home unsupervised.

Sleeping in the same room or bed as a child with whom they are working.

Condoning or participating in the behaviour of children that is illegal, unsafe or abusive.

Acting in ways intended to shame, humiliate, belittle or denigrate children, or otherwise perpetrate any form of emotional abuse.

Discriminating against, showing differential treatment or favoring particular children, or otherwise perpetrating any form of emotional abuse.

Discriminating against, showing differential treatment or favoring particular children to the exclusion of others.

Being involved in actions or behavior that may constitute poor practice or potentially abusive behavior

Neglect or abuse

Management and staff will be trained to ensure that any signs of neglect and abuse are thoroughly investigated, reported and/or referred timeously to the appropriate social service authorities.

Neglect: Is a pattern of failing to provide for a child’s basic needs, endangering a child’s physical and psychological well-being. The end result is a child who is not getting their physical or emotional needs met.

Abuse: Refers to physical, sexual and emotional abuse. Abuse is the ill-treatment of children that will cause physical or emotional harm to the child.

Staff are trained to look for signs of abuse which might include the following signs:

they seem too anxious and withdrawn

they exhibit sudden changes in behaviour or personality and lack concentration

they tend to become aggressive suddenly

they don’t seem to have any friends and don’t possess necessary social skills

they know about adult issues that are not age-appropriate

they are covered in bruises or appear to be in some form of pain

they are continually absent from school or start to perform poorly in their studies

Neglect or abuse might be discovered or disclosed in the following ways:

A child may disclose the abuse

Some else discloses the abuse and relays what a child may have told them or observed the abuse

A child may show signs of physical injury or a sudden change in behaviour

When a staff member suspects or becomes aware of abuse or neglect they will take the following action:

Listen carefully to the person reporting the abuse and take down all the facts

Be respectful and compassionate with the person reporting the abuse

Keep the report confidential except to report it to authorised management immediately

Management will do a thorough investigation and record all the evidence in writing. Evidence recorded will include:

̵Name of child

̵Name of parents

̵Name of person who reported the abuse

̵Details of the incident/neglect/abuse

̵Actions taken

̵Referral parties

Based on the nature of the incident management will make a decision as to whether to report the incident to the relevant social services department.

Management will maintain a list of referral agencies that will be contacted or provided to care givers.

If a child dies while attending, or because of an incident that happened at the ECD centre, a staff member of the centre must immediately report the child’s death to:

̵the care-giver of the child;

̵a police official, who should make sure that the death is investigated if an unnatural cause of death is suspected; and

̵The provincial HSD.

When the provincial HSD receives a report of an incident he or she must arrange for an investigation to be done.

Types of Data collected: Usage Data


The centre may use personal data for the following purposes:

· To provide and maintain our Service, including to monitor the usage of our

Service.

· To maintain our administration system: to record information about yourself,

your child, your child’s progress and our/your financial records.

· To contact you: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications, surveys regarding updates or informative communications related to the service.

· To provide you with news, new policies, special offers and general information

about our service.

· To manage Your requests: To attend and manage your requests to us.

· For other purposes: We may use your information for other purposes, such

as data analysis, identifying usage trends, determining the effectiveness of our

service and to evaluate and improve our Service, and your experience.


We may share Your Personal Information in the following situations


· With Service Providers: We may share your personal information with service

providers and they may contact you to monitor and improve our service.

· For Regulatory Authorities: We may share your personal information with

regulatory bodies when required by law to do so.

· For Research Agencies: We may share your personal information with

research agencies that are studying the effectiveness of our service. Research

agencies will be required to anonymise any published studies.

The centre will retain your personal data only for as long as is necessary for the

the extent necessary to comply with our legal obligations (for example, if we are

Your information, including Personal Data, is processed at the centres operating offices and in any other places where the parties service providers involved in the processing are located.
